Predictive Logistics, Inc. d/b/a RigPark (“Company”, “We”, “Us” or Our”) respects your privacy and are committed to protecting it through our compliance with this Privacy Policy and as it may be amended from time to time (the “Policy”).

This Policy describes the types of information we may collect from you or that you may provide when you visit the website www.rigpark.com (our “Website”) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This Policy applies to information we collect:

  • In email, text, voice calls, and other electronic messages between you and this Website or the Company;
  • In connection with the establishment of an account with RigPark;
  • Through or via the use of mobile and desktop applications you download from this Website or other third party sites, which provide dedicated non-browser-based interaction between you and this Website or the Company;
  • Via cameras placed at parking locations;
  • In connection with towing or other services provided by third parties; and
  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

Unless covered above, this Policy does not apply to information collected by:

  • us offline or through any other means, including on any other website operated by Company or any third party (including our affiliates and subsidiaries); or
  • any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on the Website.

Please read this Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to register for our services, create an account with us; use our Website, our services, or our mobile and desktop applications; or to park at our locations. By creating an account; accessing or using this Website or our mobile or desktop applications, or parking at our locations, you agree to this Policy. This Policy may change from time to time (see Changes to Our Privacy Policy). Your creation or maintenance of an account, continued use of this Website and any mobile or desktop applications, or parking at one of our locations, after we make changes to this policy is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

Children Under the Age of 13

Our services, Website and mobile or desktop applications are not intended for children under 13 years of age. No one under age 13 may create an account with us, provide any information to or on the Website, or in or through the mobile or desktop applications, or use our services. We do not knowingly collect personal information from children under 13. If you are under 13, you are not authorized nor should you create an account with us, use or provide any information on this Website, any mobile or desktop applications, or on or through any of its features/register on the Website or any mobile or desktop applications, make any purchases through the Website or any mobile or desktop applications, use our services, use any of the interactive or public comment features of this Website or any mobile or desktop applications, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. Information We Collect About You and How We Collect It

We collect several types of information from and about users of our services, accounts, Website and our mobile and desktop applications, including information:

  • by which you may be personally identified, such as name, postal address, e-mail address, telephone number, drivers license, credit card information, Transportation Worker Identification Credential, license plate, DOT number, any other identifier by which you may be contacted online or offline, images, or any other information the Website or any mobile or desktop applications collects that is defined as personal or personally identifiable information under applicable law (“personal information”);
  • that is about you but individually does not identify you, such as your vehicle, license plate, company, registration or identification, or motor carrier identification number, vehicle model, make and color; and/or
  • about your Internet connection, the equipment you use to access our Website , any mobile or desktop applications and usage details.

We may incidentally collect, record and store images of you when we are determining whether vehicles which are parked at our locations have properly paid for our services.  These images of you will not be used to identify you by us although such images may be used by police personnel or others, including property owners or lessees, in connection with determining whether actions or crimes occurred at the location.

Personal information, however, does not include “de-identified,” “anonymous,” or “aggregate” information – which are not associated with a specific person or entity.

We collect this information:

  • Directly from you when you provide it to us.
  • From cameras we may place at our parking locations.
  • Automatically as you navigate through the site. Information collected automatically may include usage details, IP addresses, and information collected through cookies, and other tracking technologies.
  • From third parties, for example, our business partners and from websites you may use to access our Website and/or download our mobile or desktop applications.

Information You Provide to Us.  The information we collect on or through our registration process, our Website, the use of our service, or any mobile or desktop applications may include:

  • Information that you provide by filling in forms on our Website or any mobile or desktop applications. This includes information provided at the time of registering to use our services, our Website or any mobile or desktop applications, purchasing our services, executing our Short Term Parking Space Sublicense, or requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with our Website.
  • Records and copies of your correspondence (including phone number and email addresses), if you contact us.
  • Your responses to surveys that we might ask you to complete for research purposes.
  • Details of transactions you carry out through our Website or any mobile or desktop applications, and of the fulfillment of your orders. You may be required to provide financial information before being allowed to purchase services through our Website or any mobile or desktop applications.
  • Your search queries on the Website.

You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Website, or transmitted to other users of the Website or third parties (collectively, “User Contributions”). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages/you may set certain privacy settings for such information by logging into your account profile, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information From Other Sources

We may also obtain information about you from other sources. For example, we may receive credit information from third-party sources before initiating your service, and updated address information from our suppliers or other vendors. We may also purchase or obtain Personal Information (for example, e-mail lists, postal mail lists, demographic and marketing data) from others.

Information We Collect Through Automatic Data Collection Technologies.  As you navigate through and interact with our Website and any mobile or desktop applications, or use of our services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Website, including video or picture images, traffic data, location data, logs, and other communication data and the resources that you access and use on the Website or our parking locations.
  • Information about your truck, computer and Internet connection, including your IP address, operating system, and browser type, and your location.

Some of the information we collect automatically is statistical data and may include personal information, and we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Website, our mobile or desktop applications, and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our Website according to your individual interests.
  • Speed up your searches.
  • Recognize you when you return to our Website.

The technologies we use for this automatic data collection may include:

  • Cameras: We may place cameras at certain parking locations.
  • Applications.  We may collect location information from you when you access our services through our phone and web applications.

Some browsers have incorporated “Do Not Track” features. Most of these features, when turned on, send a signal or preference to the websites you visit indicating that you do not wish to be tracked. Those sites (or the third party content on those sites) may continue to engage in activities you might view as tracking even though you have expressed this preference, depending on the sites’ privacy practices. Because there is not yet a common understanding of how to interpret the DNT signal, we do not currently respond to the browser DNT signals on when you use our services and products or interact with our Website or online services.

Third-Party Use of Cookies and Other Tracking Technologies.

Some content or applications, including advertisements, on the Website are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

We do not control these third parties’ tracking technologies or how they may be used. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for licensing of parking spaces, billing and collection;

  • To allow you to participate in interactive features on our Website and our mobile or desktop applications;
  • To provide you with the services you purchase from us;
  • To comply with local, state and federal laws, ordinances, codes and regulations;
  • In any other way we may describe when you provide the information; and
  • For any other purpose with your consent.

We may also use your information to contact you about our own and third-parties’ goods and services that may be of interest to you. We may use the information we have collected from you to enable us to display advertisements to our advertisers’ target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Disclosure of Your Information

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or you provide as described in this Privacy Policy:

  • To our subsidiaries and affiliates;
  • To contractors, service providers, investors, financial, legal, tax and accounting advisors and professionals,  and other third parties we use to support our business, including credit card companies, towing companies, banks, credit card clearing companies, and financial institutions;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Predictive Logistics, Inc.’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Predictive Logistics, Inc about our Website users is among the assets transferred;
  • To third parties to market their products or services to you if you have not opted out of these disclosures. We contractually require these third parties to keep personal information confidential and use it only for the purposes for which we disclose it to them.   • To enforce or apply our terms of use or Short Term Parking License and other agreements, or initiate, render, bill, and collect for services (including to collection agencies in order to obtain payment for our services);
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Predictive Logistics, Inc., our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction;
  • in connection with claims, disputes, or litigation – in court or elsewhere;
  • when information is reported to the Spam Reporting Service, it may be shared with government agencies and others that work to combat spam and prevent fraudulent, deceptive, and unfair practices; and to facilitate or verify the appropriate calculation of taxes, fees, or other obligations due to a local, state, or federal government.

Advertising

You may see advertisements when you visit our Website, mobile websites, or in mobile applications.  We may help advertisers better reach our customers by providing certain customer information, including device type, geographic information, language preferences or demographic information obtained from other companies.  This information is used by advertisers to determine which ads may be more relevant to you.  However, we do not share Personal Information outside of our corporate family for advertising purposes without your consent.  Some examples of the types of advertising you might see include:

Our Ads on Our Websites and Applications. We may provide advertisements, such as banner ads, on our Website, mobile websites, and in mobile applications and widgets you may download, access or use on your device.

Other Company Ads on Our Websites and Applications. You may also see third-party advertisements on some of our websites, services, in applications or on devices. These third-party advertisers, or their ad networks, may place or access cookies, web beacons, or similar technologies on your device and may collect certain anonymous or de-identified information about your visit on our websites. The third-party advertisers who provide these ads may use this information to provide you with advertising on our websites, as well as on other websites. We do not have control over or access to any information contained in the cookies that are set on your computer or device by ad servers, ad networks, or third-party advertisers.

Our Ads on Other Websites. We may ask third-parties to place advertisements about our products and services on other websites, mobile websites and in mobile applications and widgets. The use of cookies, web beacons, or similar technologies by such third-parties on other websites is subject to any applicable privacy policies that they may have, not this Policy.

Interest-Based Ads. You may receive ads from us and our ad providers that are tailored to your interests. These interest-based ads are selected based on your use of our services and products as well as other information obtained by us and our ad providers. None of this information is Personal Information.

  • We do not provide your Personal Information to third-party advertisers without your consent.
  • Advertising may be tailored to the interests that advertisers have inferred from your browsing of our websites or other websites or applications with which the third-party partners to provide advertising.
  • We may provide third-party advertisers with aggregated or de-identified location, demographic or similar data (unrelated to your browsing activities) that does not personally identify you. This data may be used by advertisers to help tailor their ads on our websites, and on other sites and applications.
  • We, and our providers, may use a de-identified profile of your web-browsing and application use activity and interests. This profile does not contain information that identifies you personally, but may include a unique or encrypted identifier that enables your device to be matched to a profile of your browsing activity and de-identified characteristics about your interests.

Your Role in Protecting Your Privacy

Protecting Your Personal Information.  You play an important role in ensuring the security of Personal Information. We encourage you to use passwords to prevent unauthorized access to your online account. You may also establish an optional password to identify yourself during calls with our Customer Service representatives. We recommend that you use unique, non-obvious passwords, that you periodically change your passwords, and that you not share your passwords with others.  Many devices store information in the device’s memory, on the SIM card, and/or on SD memory cards. Therefore, before selling, discarding, trading in, or giving away your device, be sure you remove and retain your SIM and SD memory card and follow the manufacturer’s instructions for deleting Personal Information or other data on the device. (This can be found in your owner’s manual or on the manufacturer’s web site.).  You should also notify us if you cease to use our services so that we can delete your account.

Limit Third-Party Access.  If you provide a third-party with access to your device, or share your password or PIN, you should understand that your Personal Information may be accessed, deleted, altered, or transferred to another device or our network servers by the person using the device, and that we will treat that user as you for purposes of this Policy.

Social Networking, Forums and Chat Rooms.  If you use or link to a public forum, bulletin board, chat room, or social network on or from our web site, be aware that any information you post or submit can be read, collected, or used by other users of these forums, including to send you unsolicited messages. We urge you not to share your Personal Information (for example, your name, phone numbers, addresses, passwords or PIN, etc.) on these websites.  We are not responsible for access to or use of information you choose to submit or share with others. For example, if you post your wireless number on a social network in order to receive updates by text message, standard message charges will apply to such messages.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.
  • Disclosure of Your Information for Third-Party Advertising.   • Promotional Offers from the Company. If you do not wish to have your email address/contact information used by the Company to promote our own or third parties’ products or services, you can opt-out by checking the relevant box located on the form on which we collect your data or by sending us an email stating your request to info@rigpark.com. If we have sent you a promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to the Company as a result of a licensing transaction, service purchase, or other transactions.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website.

Accessing and Correcting Your Information

You can review and change your personal information by logging into the Website, or any mobile or desktop applications, and visiting your account profile page.

You may also send us an email at info@rigpark.com. to request access to, correct or delete any personal information that you have provided to us. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to info@rigpark.com.

Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. We do not store any credit card information.  However, no measures are perfect to prevent unauthorized third parties from accessing or using your information.   

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website and desktop and mobile applications, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website like message boards. The information you share in public areas may be viewed by any user of the Website.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

Changes to Our Privacy Policy
